NHTSA Opens a Lane Without Controls

One federal exemption meets different state operating gates before a fare can move.

The federal gate opened on a machine built without a steering wheel, pedals or a human driver's sightline. NHTSA granted Temporary Exemption No. 2026-01 only to the Zoox sedan model, allowing Zoox to manufacture and introduce into interstate commerce for commercial deployment up to 2,500 exempt vehicles in any rolling 12-month period. The authority runs from Federal Register publication through July 31, 2028. It covers specified provisions in eight Federal Motor Vehicle Safety Standards, rather than a blanket release from federal vehicle law. The steering wheel has left the bill of materials; the paperwork has multiplied. [E1][E2]

Purpose-built hardware changes the comparison vehicle. Zoox's cabin uses facing carriage seats inside a longitudinally symmetrical body, while lidar, radar, visible and infrared cameras, microphones, planning software and control systems perform the driving task. NHTSA judged many exempted provisions to be driver aids that add little to a vehicle never intended for occupant control: wipers and defogging requirements aimed at driver vision, mirrors and rear displays, manual brake-control assumptions, and other provisions shaped around a conventional front-facing cockpit. The agency also addressed glazing and occupant-protection details that conflict with the service-bay and seating geometry. [E1]

That finding has a tight boundary. NHTSA compared the exempt Zoox vehicle with an otherwise identical ADS-operated vehicle that complied with the cited provisions. Its safety-equivalency analysis reached only those specific requirements, and the order says the agency made no general conclusion about compliance with every other applicable standard. NHTSA also did not broadly certify the automated driving system. It considered ADS maturity when deciding whether the exemption served the public interest and when designing oversight conditions, while leaving full compliance analysis and continuing safety obligations with the manufacturer. The moving part is the Operational Authorization. NHTSA can issue several authorizations for different areas, routes or operations, then modify their conditions as the vehicle or operating domain changes. Zoox must provide vehicle, ADS and other required data, and the authorizations enter the public docket. Public-road maps must show current operating areas by city, county or state and change within 14 days of any substantive boundary shift. Annual reports must identify every exempt vehicle by VIN, say whether each still operates on public roads, and list the locations of remote-assistance centers supporting the fleet. [E1]

The remote stack stays physically and legally close. Personnel performing safety-critical tasks, including remote assistants, must work within the continental United States, in locations whose latency, jitter and data conditions preserve the vehicle's safe state and whose jurisdiction keeps workers reachable by U.S. regulators and law enforcement. Zoox must retain operational control for each vehicle's life and may neither sell nor transfer possession or title. NHTSA can inspect the vehicles, modify or suspend the exemption, or revoke it when safety risk, unremedied defects, misleading information or breached conditions undermine the grant. [E1]

Washington's order supplies only the federal vehicle-standard layer. California still presents separate operating gates. The CPUC ledger lists Zoox with drivered-pilot and driverless-pilot passenger-service authorities, without a driverless-deployment permit. The DMV separately lists Zoox for driverless testing in Foster City and San Francisco, under defined weather and 45 mph limits. Those records support testing and pilot operation; they do not convert the new federal exemption into permission for unrestricted paid service. Every Zoox vehicle must still satisfy applicable state and local requirements and hold the permits required for each roadway it traverses. [E1][E3][E4]

Other states show how the stack can vary without establishing that Zoox already carries fares there. Texas requires an active TxDMV authorization before commercial Level 4 or Level 5 operation, backed by vehicle records, federal compliance, minimal-risk capability, insurance and an emergency-interaction plan; the department can restrict or revoke that authority. Florida permits a fully autonomous vehicle to operate without an in-cabin licensed operator, treats the engaged ADS as the operator, and preempts many local requirements, while preserving airport and seaport powers over fees and staging. The federal exemption therefore opens a model-specific manufacturing and deployment lane. A fare still needs the state gate, the route envelope and the operating authorization to align. The bargain remains narrow and physical: controls leave the cabin; ownership, maps, VINs, remote accountability and revocable oversight stay attached to every machine. [E1][E5][E6]
