Managua’s draft leaves election day in place and rewrites who may reach it. The clause bars anyone who directed, led, financed, joined directly or indirectly, or had “cualquier tipo de vinculación” with an attempted or completed coup from elected office and presidential appointments [E1][E2]. Because the wording reaches past conduct and indirect association, the state could attach constitutional consequences to labels already used against the 2018 opposition [E2][E4]. The immediate legal move is a permanent eligibility filter inside an electoral system [E1][E2].
It also proposes “siete años renovables” for the co-presidency, extending the six-year periods written into the Constitution published in February 2025 [E1][E5]. Renewable seven-year terms would lengthen each cycle and reduce the frequency of the national contest the draft still promises [E1]. Combined with a broader disqualification rule, the calendar and the candidate screen pull in the same direction: fewer openings and a narrower field [E1][E2]. The design entrenches power through duration as well as exclusion [E1][E2].
Partial reform follows a staged machine. A special commission may consult for up to 60 days, after which the text must secure 60% of all deputies in two successive legislatures; the president has no veto over a partial constitutional reform [E3][E4][E5]. Officials are aiming for a first vote in early September 2026 and a second legislative passage in early 2027 [E3][E4]. The FSLN’s supermajority puts both thresholds within the governing bloc’s existing reach [E4].
One document is still missing: the full initiative. As of 29 July, the Assembly had publicized excerpts and a consultation timetable, but had not published the complete draft in the official legal database [E1][E2][E4][E5]. That gap blocks firm claims about transitional articles, precise election dates, enforcement appeals, exceptions, or whether the seven-year term would immediately extend the current mandate [E1][E4]. The quoted clauses establish the proposal’s direction while leaving its complete scope unresolved [E1][E2].
The proposal builds on an existing ladder of exclusion. The 2025 Constitution already fixed six-year co-presidential terms and contained narrower ineligibility language tied to coup leadership or financing [E5]. Ordinary law and subsequent measures had already branded opponents as “traidores a la patria,” stripped nationality and property in documented cases, and barred political participation [E2][E4]. Constitutionalizing a broader formula would make reversal harder because a future majority could no longer remove the ban through an ordinary statute alone [E2][E4][E5].
Enforcement is where the clause acquires teeth. The draft would give the Supreme Electoral Council wider authority to cancel candidacies or party legal status when it finds a prohibited connection [E2]. Terms such as indirect participation and any type of linkage create a large administrative perimeter around the state’s own account of the 2018 crisis [E2][E4]. A ballot can remain formally plural while the decisive competition is settled earlier, in eligibility rulings issued under the governing project’s constitutional vocabulary [E2][E3][E4].
The strongest counter-case is textual and procedural. Elections remain in the official design, the proposal still requires two legislative approvals, and the unpublished draft could contain limits that the excerpts do not show [E1][E3][E4]. An immediate-abolition label would outrun the available text; the documented mechanism converts political loyalty into a constitutional qualification for appearing on the ballot [E1][E2][E4]. If the two votes proceed on schedule, Nicaragua will print ballots whose candidate lists have already been constitutionally filtered [E2][E3][E4].
